It shall be unlawful for any person or entity to perform any kind of work activity including, but not limited to excavation and construction within any easement, right-of-way or any other type of dedication for the benefit of the City without first obtaining a work permit from the City Inspection Department.

Before any work activity is allowed to take place on property described in the permit, the applicant for the permit must secure an underground locating service to determine what, if anything, is under the surface of the tract upon which the work activity will take place. A copy of any written location report must be supplied to the City Inspection Department and all utilities and other items located must be flagged to indicate what was located and its location.

Following any work activity, the surface of the location or any surrounding location that was disturbed by the work activity shall be restored to its original condition.

For any violation or failure to comply with these provisions of this article, upon conviction, the permit holder may be fined not less than $100.00 or more than $500.00 and/or sentenced up to 30 days in jail.
