A CHARTER ORDINANCE OF THE CITY OF AUGUSTA, KANSAS, EXEMPTING THE CITY OF AUGUSTA, KANSAS, FROM THE PROVISIONS OF K.S.A. 25-2108a(b) AND PROVIDING A SUBSTITUTE PROVISION STATING WHEN IT IS NECESSARY TO HOLD A PRIMARY ELECTION FOR CITY OFFICES DETERMINED BY THE NUMBER OF CANDIDA TES FILED FOR EACH CITY OFFICER AND THE NUMBER OF CANDIDATES TO BE ELIMINATED BY A PRIMARY ELECTION.

Section 1. That the City of Augusta, Kansas, a second class city, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself from and make inapplicable to it the provisions of K.S.A. 25-2108a(b) in so far as it relates to the primary and general elections of City Officers; providing a substitute method for determining when a primary election is necessary and how many candidates will be eliminated by the primary elections and the number of candidates that will appear on the general election ballot.

Section 2. No primary election of city officers be held unless by holding such primary one (1) or more persons will be eliminated as candidates for an office. In the event there are not more than (2) candidates for any one office the names of the candidates for such office shall not appear on the primary election ballots, and there shall be no primary election for such office, but the names of such candidates shall be placed on the general city election ballot.
