CHAPTER 12. PUBLIC PROPERTYCHAPTER 12. PUBLIC PROPERTY\Article 1. General Provisions

As provided and allowed by K.S.A. 12-1301 et seq., the city may from time to time designate certain areas of the city to be a part of the city park system. The use of all lands which are within the park system shall be regulated and controlled by these ordinances and such rules and regulations as may be adopted.

(a)   AUTHORITY; In furtherance of the governing body’s duties pursuant to K.S.A. 12-1304, there shall be appointed by the Governing Body a Park Advisory Board which shall have the responsibility and authority to advise the governing body concerning the regulation and use of the land and property which are a part of the city park system. The Park Advisory Board shall have the authority to propose rules and regulations which set forth standards of conduct and activities which are permitted or prohibited within the park system.

(b)   APPOINTMENT; The Governing Body shall appoint seven (7) members to the Park Advisory Board, of which five (5) members shall be residents of the city or reside within the City of Augusta’s designated growth area, and the other two (2) members shall be members of the city’s Governing Body.

(c)   TERMS; Park Advisory Board members shall serve staggered three (3) year terms. The two members appointed from the Governing Body shall serve a term of one year. All members shall serve a maximum of two consecutive terms and must be off the board for one term before being eligible for reappointment.

(d)   REMOVAL OF MEMBERS; Park Advisory Board members may be removed from the board by majority vote of the Governing Body.

(e)   VACANCIES IN PARK ADVISORY BOARD; HOW FILLED; Whenever a vacancy occurs by virtue of removal, resignation, death or disqualification, the Governing Body shall appoint a replacement at their earliest convenience by majority vote to fill the unexpired term of the member leaving the membership.

The building or starting of fires is prohibited in the park system except:

(a)   In places designated as picnic areas and then only in fireplaces, grills or other utensils specifically designed to hold and contain fires;

(b)   Upon written application for and issuance of a written temporary permit by the City of Augusta, Kansas for the display of fire on the peninsula extending into the Augusta City Lake at Garvin Park, which shall be signed, contain any specific additional conditions as deemed prudent by the City of Augusta, Kansas including but not limited to safety provisions and prohibitions, and specify the exact dates and hours of said written temporary permit; or

(c)   As may be further permitted by the park board.

It shall be unlawful for vehicles to be driven or parked except in the designated roadways and parking areas of the city park system. The city manager shall cause to be posted speed limits and other driving regulations which apply to the park system. All other driving shall be governed by the traffic code of the city.

The city manager shall cause to be posted in each area of the park system the hours that the public shall be allowed access to the specific area of the park system. If no hours are posted the specific area shall be available to the public at all times.

All persons fishing by any means in Lake Augusta shall be required to obtain a city fishing license as provided by the rules and regulations pertaining thereto. The licenses may be obtained from the city clerk or any other person authorized by the city to issue licenses and such license shall entitle the holder to fish in all waters within the park system. Any resident age 65 or older or under the age of 16 years shall not be required to obtain a license to fish in Lake Augusta. The fees for city fishing licenses shall be established by Resolution of the Governing Body of the City of Augusta, Kansas.

Any person boating on a lake under control of the City of Augusta shall provide a life preserver of a jacket type only, coast guard approved, and all such persons shall wear the same while in any boat while under sail or under power.

Any citations issued pursuant to the provisions as detailed in this chapter shall be handled in accordance with the general penalty provisions as established in section 1-116 of this code.
